Welcome to AfterHours ("we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our website, platform, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility #

You must be at least 18 years old to use our platform. By using our Service, you confirm that you are of legal age and have the capacity to enter into a binding agreement.

2. Account Registration #

You must register an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate and complete information when creating an account.

3. User-Generated Characters #

You may create, upload, and interact with AI-powered characters ("Characters") on the platform. You are solely responsible for the content and metadata associated with any Character you submit or host.

Prohibited Content Includes:

  • Illegal content or activity
  • Harassment or abuse of others
  • Non-consensual NSFW content
  • Impersonation without clear parody
  • Any Character violating applicable laws

We reserve the right to moderate or remove any Character for any reason.

4. NSFW and Mature Content #

Our platform permits the creation and interaction with NSFW (Not Safe For Work) characters, provided they comply with our content guidelines and all applicable laws.

You must opt-in to view NSFW content. Users are responsible for flagging their Characters accurately.

5. Subscriptions and Billing #

We offer paid subscription plans that unlock premium features such as:

  • Access to exclusive Characters
  • Increased usage limits
  • Priority access to services

By subscribing, you agree to the pricing, billing, and cancellation terms disclosed at the time of purchase. Subscriptions automatically renew unless cancelled before the next billing cycle. No refunds will be issued for partial use.

6. Use of Third-Party Endpoints #

You may supply your own AI model endpoints (such as LM Studio) for personal use on the platform. However:

You may only use endpoints that you personally own or have explicit permission to use.

Use of unauthorized third-party endpoints (e.g., SpicyChat endpoints you do not own) is strictly prohibited.

Violations may result in:

  • Immediate account suspension or termination
  • Legal action where appropriate

7. Termination of Accounts or Characters #

We reserve the right to terminate any account or delete any Character at any time, with or without cause or notice. This includes but is not limited to violations of these Terms, suspicious activity, abuse of platform resources, or community guideline breaches.

No compensation or refund will be issued upon termination.

8. Data and Analytics #

We use analytics tools (including PostHog) to track user behavior such as:

  • Character interactions
  • Favorites
  • Chat sessions
  • Engagement duration

9. Intellectual Property #

All platform code, design, branding, and underlying models are owned by AfterHours. You may not copy, distribute, or reverse-engineer the Service.

Users retain ownership of original Characters they create, but grant us a non-exclusive license to display and promote them on the platform.

10. Modifications to Terms #

We may modify these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the new Terms. We recommend reviewing this page periodically.
